ESTATE PLANNING
Estate planning is about more than writing a Will. It’s the process of making legally binding arrangements for what happens to your assets, responsibilities, and care decisions both during your lifetime (if you lose capacity) and after your death. A complete estate plan can include Wills, enduring powers of attorney, medical treatment decision maker appointments, superannuation nominations, and, if relevant to you, trust succession.
You don’t always need a lawyer to prepare estate documents. However, DIY or generic templates often miss key legal issues, use unclear terminology, omit dealing with state and federal taxes, don’t cover complex family situations, and may not be valid when tested. Working with a lawyer gives you the assurance that your plan is tailored, compliant, and enforceable. It also helps reduce the risk of disputes and delays for your loved ones.
At Woolcock Lawyers, we work exclusively in estate planning and deceased estates. We take the time to understand your family circumstances, your financial position, and your wishes. We’ll give you clear advice about your options and the risks involved, so you can make informed decisions with confidence. Wherever possible, we offer fixed fees and follow a negotiable value-based pricing model, so you know exactly what to expect and can see the value in the advice you receive.
DECEASED ESTATES
When someone dies, the process of finalising their estate can be overwhelming. It often involves applying for probate or letters of administration, collecting and transferring assets, paying debts and taxes, and distributing inheritances. Even in straightforward cases, there are legal steps and timeframes that must be followed.
We adapt our services to meet the executor’s level of autonomy or budget. This might mean providing a full-service option where every form and step is handled on your behalf, or offering guidance at key touchpoints, or simply giving a legal overview to support your own work.
At this stage, we do not handle disputes or estate challenges ourselves; however, we have a network of capable and trusted lawyers to whom we can refer you if the need arises.
